1. Acceptance of Terms
These Terms & Conditions govern access to and use of www.hightide.law and related online services provided by Law Office of Charisma Fozard, PLLC, doing business as High Tide Legal. By using the website, you agree to these Terms & Conditions. If you do not agree, do not use the website.
2. Informational Purposes Only; No Legal
Advice
Website content is provided for general informational purposes only. It is not legal advice and should not be relied upon as a substitute for advice from a lawyer who has considered the specific facts and applicable law. Laws and legal interpretations change, and we do not warrant that website content is complete, current, or applicable to a particular situation.
3. No Attorney-Client Relationship
Accessing the website, sending an inquiry, submitting an intake form, registering for a webinar, receiving general information, or scheduling or paying for a consultation does not by itself create an attorney-client relationship. Such a relationship is formed only when High Tide Legal confirms the engagement in a written agreement signed or otherwise accepted by High Tide Legal and the client.
Do not send confidential or time-sensitive information unless High Tide Legal has requested it or confirmed that an attorney-client relationship exists. We may be unable to represent you, including because of a conflict of interest.
4. Legal Services and Engagement
Agreements
Any legal representation is governed by a separate written engagement agreement. If these Terms & Conditions conflict with an executed engagement agreement concerning legal services, the engagement agreement controls to the extent of the conflict, subject to applicable law and professional obligations.
Past results do not guarantee or predict a similar outcome. No statement on the website guarantees any particular result.
5. Consultations, Scheduling, and Payments
Consultation availability is not guaranteed until confirmed. You are responsible for providing accurate scheduling and contact information and for attending at the confirmed time. Fees, scope, cancellation terms, and payment arrangements for legal services may be stated during scheduling or in an engagement agreement.
Payments may be processed by third-party providers and may be subject to their terms. High Tide Legal does not guarantee uninterrupted availability of a scheduling or payment platform.
6. SMS/MMS Messaging Terms
Program Description
By affirmatively opting in, you authorize High Tide Legal to send SMS or MMS messages to the mobile number you provide. Depending on your consent and relationship with us, messages may include appointment reminders, account or case-related updates, customer-support communications, webinar reminders, and promotional messages.
Consent
Your consent to receive promotional text messages is not a condition of purchasing legal services. Consent applies only to the telephone number and messaging purposes disclosed at opt-in. You represent that you are the subscriber or customary user of the number provided and are authorized to consent to messages at that number.
Frequency and Charges
Message frequency varies. Message and data rates may apply. Your wireless carrier’s terms and charges apply. High Tide Legal and participating carriers are not liable for delayed or undelivered messages to the extent permitted by law.
Opt-Out and Help
Reply STOP to any message to opt out. We may send one confirmation message acknowledging the opt-out. You may also withdraw consent by emailing info@hightide.law or calling (984) 201-9190 and clearly identifying the mobile number and messaging program involved. Reply HELP for help or contact us using the information above.
We will honor reasonable revocation requests as required by applicable law. After opting out, you may need to provide new consent before receiving messages from the relevant program again.
Privacy
Mobile opt-in information and consent data will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Our use of personal information is further described in the Privacy Policy.
Supported Carriers and Number Changes
Messaging availability may depend on your device, carrier, and coverage. If you change, transfer, deactivate, or relinquish your telephone number, you agree to opt out first or promptly notify High Tide Legal.
7. Webinar and Educational Content
Webinars, presentations, downloads, and educational materials are general information and do not constitute individualized legal advice. Participation does not create an attorney-client relationship. Do not disclose confidential facts in a public webinar or group setting.
8. Permitted Use
You may use the website only for lawful, personal, and legitimate business purposes. You may not:
- Interfere with website security or operation.
- Attempt unauthorized access to any system or account.
- Introduce malicious code or use automated methods to scrape or burden the website.
- Misrepresent your identity or submit false information.
- Use website content in a manner that violates law or another person’s rights.
9. Intellectual Property

Nothing in this section limits duties owed to a client under an applicable engagement agreement, professional-conduct rule, or law.
12. Limitation of Liability
To the fullest extent permitted by law, High Tide Legal will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability use the public website or reliance on its general informational content. This limitation does not apply where liability cannot lawfully be limited and does not alter duties arising from an attorney-client relationship.
13. Governing Law and Venue
These Terms & Conditions are governed by the laws of North Carolina, without regard to conflict-of-law rules. Any dispute concerning only the public website or these Terms & Conditions will be brought in a court of competent jurisdiction serving Durham County, North Carolina, unless applicable law requires otherwise. This provision does not override an engagement agreement or any rule governing disputes between lawyers and clients.
14. Users Under 18
A person under 18 may not engage High Tide Legal independently and must be represented or assisted by a parent, legal guardian, or other legally authorized adult as applicable. The adult is responsible for supervising the minor’s website use and communications.
15. Changes and Severability
We may update these Terms & Conditions by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
